Terms and Conditions for
Mitsubishi Yowa Sports Club

Article 1. Name

These terms and conditions apply to Mitsubishi Yowa Sports Club (the “Club”).

Article 2. Location

The Club is located at the following address: 2-8-1 Sugamo, Toshima-ku, Tokyo, Japan, 170-0002.

Article 3. Management

The Club is managed by Mitsubishi Yowakai Foundation (the “Foundation”).

Article 4. Purpose

The purpose of the Club is to give its members access to the Foundation’s Sugamo sports center (the “Facility”) so that the members, through sport, will improve their mental and physical health and increase their social bonds with one another.

Article 5. Eligibility for Membership

To be eligible for membership of the Club, an individual must satisfy the six conditions listed below, satisfy the conditions stipulated in Article 6, and be deemed by the Foundation as suitable for membership.

  1. (1)

    The individual must understand the purpose of the Club as stipulated in Article 4 and must agree to abide by these terms and conditions and any other rules that the Foundation has established.

  2. (2)

    The individual must be fit to engage in sport and must accept that whenever he/she engages in sport at the Club he/she does so at his/her own risk.

  3. (3)

    The individual must undergo a physical test before or after enrolment in accordance with separately stipulated rules, and the test must reveal no impediments to the individual’s use of the Facility.

  4. (4)

    The individual must have no communicable disease or any condition that exposes others to the risk of infection.

  5. (5)

    The individual must have no tattoos.

  6. (6)

    The individual must have no association with any organized crime groups.

Article 6. Membership Categories

1.

The categories of membership are as shown in the following table. However, membership categories other than those shown below may be established as necessary.

Core Company Alumnus Former employees of companies that are members of Mitsubishi Yowakai Foundation who retired upon reaching the mandatory retirement age or retired in similar circumstances
Non-Core Company Member Employees of Non-Core Companies that the Club recognizes in accordance with separately stipulated rules
Mitsubishi.com Company Member Employees of Mitsubishi.com Companies that the Club recognizes in accordance with separately stipulated rules
Full-Time Members
Daytime Members
Nighttime Members
General public (eligibility is restricted to individuals aged 15 or above, excluding junior high school students)

Family members of Full Members can themselves become members of the Club (such members are hereafter referred to as “Club Family Members”) by undergoing the designated application procedure. In these terms and conditions, a “family member” means the spouse, child, child-in-law, or parent of a Full Member.

The Foundation reserves the right to accept or decline an application for membership at its sole discretion. The Foundation is not required to explain its reason for declining an application.

Article 7. Enrolment

To become members of the Club, individuals must undergo the application procedure specified separately and gain approval from the Foundation.

Article 8. Club Fees

Members pay membership dues and other fees (collectively, “Club Fees”) as specified separately. Once paid, Club Fees are never returned for any reason whatsoever.

Article 9. Changes to Club Fees

The Foundation reserves the right to change club fees as circumstances warrant.

Article 10. Member ID

The Club issues a member ID to every member.

2.

Use of a member ID is restricted to the named holder of the ID.

3.

If a member loses his/her ID, he/she must apply for a replacement as specified separately and must pay the specified fee for the issuance of the replacement ID.

4.

When using the Facility, members must carry their member ID at all times and present it when requested.

5.

If a member resigns his/her membership, he/she must return his/her member ID.

Article 11. Prohibition on Transferring Membership

Members are prohibited from transferring their membership to another person.

Article 12. Changes in Member Details

Members must promptly notify the Foundation of any changes in their place of work, residence, contact details, or any other details they submitted in the application documentation.

Article 13. Change in Membership Status

1.

Members who no longer qualify for the membership category assigned to them upon enrolment must either change to a membership category for which they now qualify or resign their membership.

2.

Any family members of a Club member who has lost his/her membership status must either change to a membership category for which they now qualify or resign their membership.

Article 14. Loss of Membership

Membership is forfeit in any of the following circumstances:

  1. - The member has resigned his/her membership.

  2. - The member’s membership has been revoked.

  3. - The member has died.

Article 15. Resigning Membership, Suspending Membership

To resign their membership, members must submit the designated documentation by the last business day of the month preceding the month in which they intend to resign (this will be deemed the final month of membership). Members are not allowed to temporarily suspend their membership.

Article 16. Revocation

The Foundation reserves the right to revoke membership in any of the following circumstances:

  1. (1)

    The member has severely tarnished the reputation of, or undermined trust in, the Club.

  2. (2)

    The member has disrupted the orderly conduct of the Club or has otherwise acted in an offensive or disorderly manner, causing distress in other members.

  3. (3)

    The member has violated these terms and conditions or other rules specified by the Club.

  4. (4)

    The member is delinquent in paying Club Fees and has ignored repeated requests to pay the arrears (in such case, the member must pay all Club Fee arrears).

  5. (5)

    It has come to light that the member made one or more false statements in his/her application.

  6. (6)

    The member is otherwise deemed by the Foundation to have behaved in a manner unbecoming of a member of the Club.

Article 17. Grounds for Barring Participation or Access or for Ejecting

The Foundation reserves the right to bar access to or to eject individuals in any of the following circumstances:

  1. (1)

    The individual has violated these terms and conditions or other rules specified by the Club.

  2. (2)

    The individual has been advised by a doctor to refrain from athletic activity or is evidently in no condition for such.

  3. (3)

    The individual has a communicable disease or a condition that exposes others to the risk of infection.

  4. (4)

    The member engages in substance abuse (such as solvent inhalation or the use of cannabis or an illicit stimulant).

  5. (5)

    The member is under the influence of alcohol.

Article 18. Guests

1.

Non-members (“Guests”) can use the Facility provided they are accompanied by a member.

2.

To use the Facility, Guests must pay the guest fee specified separately.

3.

Members are entirely responsible for how their Guests conduct themselves at the Center.

4.

For operational reasons, no more than three Guests per member are permitted.

The Foundation reserves the right to set a cap on the total number of Guests who can use the Facility.

Article 19. Changes in Center

The Foundation reserves the right to remodel, refurbish, or change the layout to the Facility as necessary.

Article 20. Closure, Restricted Access

The Foundation reserves the right to close the Facility, entirely or in part, or to restrict access to the Facility in any of the following circumstances. Members must agree to refrain from seeking compensation or launching any action against the Club or Foundation in connection with such closure or restriction.

  1. (1)

    A natural disaster has occurred.

  2. (2)

    Closure is required under a law, ordinance, or administrative order.

  3. (3)

    Societal conditions have changed dramatically.

  4. (4)

    The Facility is hosting a school program, training program, competition, or special event.

  5. (5)

    The Facility is undergoing maintenance or refurbishment.

  6. (6)

    It has otherwise become necessary to close the Facility.

Article 21. Closed Days

1.

The Foundation is closed for business from August 12 to 17 (summer holiday), from December 29 to January 4 of the following year (New Year holiday), and on the last day of each month.

2.

In addition to these scheduled closing dates, the Foundation reserves the right to close the Facility whenever necessary, such as for maintenance work.

Article 22. Liability for Incidents

When individuals use the Facility, they do so entirely at their own risk and responsibility. The Club, Foundation, and any parties associated with such accept no liability whatsoever for any theft, injury, or other incident occurring on the premises of the Facility.

Article 23. Damage to Facility Property

Individuals accessing the Facility will be held liable for any damage caused to Facility property (such as equipment) resulting from their willful misconduct or gross negligence.

Article 24. Lost Property

Any personal belongings that have been left behind on the premises will be stored by the Foundation for two weeks and then disposed of.

Article 25. Prohibitions

Individuals using the Facility must observe all rules specified separately by the Foundation while on the premises of the Club or the Facility. They must also refrain from the following:

  1. (1)

    taking photos or recording videos on Facility premises without permission;

  2. (2)

    selling goods or soliciting, whether for profit-making or non-profit-making purposes, without permission; and

  3. (3)

    bringing animals into the Facility premises without permission.

Article 26. Other Matters

All matters not provided for herein and all matters related to the Foundation’s operations are as stipulated separately by the Foundation. The Foundation reserves the right to specify such matters as necessary.

Article 27. Changes to these Terms and Conditions

The Foundation reserves the right to changes these terms and conditions as necessary.

Article 28. Effective Date

These terms and conditions are effective as of April 1, 2023.
